I have a bunch of debts already in collections, what can I do?

The first thing you should do to fight debts that are in collections is to validate each debt. This process involves sending a debt validation letter to each collection agency. Under the Fair Debt Collection Practices Act (FDCPA), you have the right to request that the collection agency provide proof that the debt is legitimate, and that they have the legal right to collect it.

Here are the steps to get started:

Gather Information: Collect the details for each debt, such as the collection agency’s contact information, the amount they claim you owe, and any correspondence you’ve received.
Send a Debt Validation Letter: Write a letter to each collection agency asking for validation. (You can use the Part 1 Letters from the previous Lesson) In this letter, request that they provide:

Proof that the debt is yours.
The original creditor’s information.
Verification of the exact amount owed.

Send by Certified Mail: Send the validation letters via certified mail with a return receipt to have proof that you requested validation.
Wait for a Response: The collection agency must provide validation before they can continue collecting. If they can’t provide the proof, they must cease collection activities, and you may be able to dispute the debt with credit reporting agencies to have it removed from your credit report.

This step helps you determine if the debt is accurate and legally collectible, and it might allow you to dismiss debts that are incorrectly documented or not legally enforceable.
